NEW DELHI: The Bombay high court on Monday rejected the bail pleas of Mihir Shah, the prime accused in a deadly BMW hit-and-run case, ruling against his claims of “illegal” arrest. Shah, the 24-year-old son of former Shiv Sena leader Rajesh Shah, and his driver, Rajrishi Bidawat, had filed petitions in the court, alleging that they were detained unlawfully and seeking immediate release.
Shah was arrested on July 9, two days after he allegedly rammed his BMW into a two-wheeler in the Worli area of Mumbai, killing 45-year-old Kaveri Nakhwa and injuring her husband, Pradeep. Bidawat, who was also in the car, was arrested on the same day as the incident.
In their pleas, the duo argued that the police failed to inform them of the grounds for their arrest at the time of detention, violating the provisions of the law. Shah and Bidawat contended that their detention was unlawful under Section 50 of the Code of Criminal Procedure (CrPC), which mandates that the police must inform the arrested individual of the reasons for their arrest.
However, a division bench of Justices Bharati Dangre and Manjusha Deshpande dismissed both petitions, stating: “Both the petitions are dismissed.”
Shah and Bidawat had sought their release, claiming that further detention would violate their constitutional rights and fail to adhere to legal procedures. Both are currently in judicial custody.
In his petition, Shah sought to quash the remand orders passed by a local court, challenging his arrest as illegal.
The case has drawn attention due to the horrific nature of the incident. Shah is accused of fleeing the scene after the crash, driving with the woman’s body lodged on the bonnet for over 1.5 km, with her eventually getting caught in the car’s wheels. Police reports indicate that Shah was under the influence of alcohol at the time of the accident.
Shah’s father, Rajesh Shah, who was also arrested in connection with the case, was granted bail earlier.
