NEW DELHI: Luigi Mangione, accused killing UnitedHealth Group CEO Brian Thompson in Manhattan, faces arraignment on Monday on murder and terror charges in a state case that will run parallel to his federal prosecution.
He will respond to an 11-count indictment, including three murder charges and terrorism-related murder during the New York state court hearing. A conviction will result in life imprisonment without parole eligibility.
This is Mangione’s second New York court appearance since his arrest in a Pennsylvania McDonald’s following the December 4 early morning shooting of Thompson near a midtown Manhattan hotel hosting an investor conference.
Additionally, Mangione faces federal charges for stalking and killing Thompson, though he hasn’t entered a plea. The federal charges potentially carry a death penalty, pending the Manhattan US Attorney’s office decision.
Both federal and state proceedings will continue simultaneously, with the state trial likely preceding the federal case.
Manhattan DA Alvin Bragg at a press briefing on Tuesday detailing the state charges said that applying the terrorism statute reflected the gravity of a “frightening, well-planned, targeted murder that was intended to cause shock and attention and intimidation.”
“In its most basic terms, this was a killing that was intended to evoke terror. And we’ve seen that reaction,” he said.
Meanwhile, Mangione’s counsel Karen Friedman Agnifilo, who represents Mangione, has challenged federal and state prosecutors for presenting contradictory legal arguments. During federal proceedings last week, she described their strategy as “very confusing” and “highly unusual.”
Agnifilo said the two cases seemed completely different, and she asked prosecutors to clarify whether both would continue.
The federal complaint mentions police discovering a notebook containing handwritten pages that “express hostility towards the health insurance industry and wealthy executives in particular.”
An October 22 notebook entry allegedly detailed plans to target an insurance company executive at an investor conference. While Thompson’s killing has received widespread condemnation, some Americans frustrated with healthcare costs and insurance companies’ treatment denial practices have portrayed Mangione as a hero of their cause.
Mangione is currently detained in a Brooklyn federal facility with other notable inmates, including Sean “Diddy” Combs and Sam Bankman-Fried. He holds an Ivy League degree and had apparently isolated himself from relatives and friends recently.
