SC sets aside Calcutta HC order which advised ‘adolescent girls to control sexual urges’ | India News – Times of India

NEW DELHI: The Supreme Court on Tuesday expressed its disapproval to the statements made by the Calcutta high court, which advised teenage girls to “control their sexual desires and not give in to two minutes of pleasure.” The apex court overturned the high court’s decision that acquitted an individual charged under the Protection of Children from Sexual Offences (Pocso) Act.
In its ruling, the Supreme Court said that it has issued comprehensive guidelines on the proper application of the Pocso Act and the manner in which judges should compose their judgments.

The SC had taken suo motu cognisance of the order and had said on December 8 that judges were supposed to decide a case on the basis of law and facts, and should not resort to preaching in judicial proceedings. It had also questioned the validity of the HC order acquitting the accused who was booked under the IPC and Pocso Act.

The Calcutta high court in 2023 had said, “Control sexual urge/urges as in the eyes of the society she is the looser when she gives in to enjoy the sexual pleasure of hardly two minutes.”
The HC had made the observation while overturning a man’s conviction under the Pocso Act. The court determined that the relationship between the accused and the alleged victim was consensual in nature.
