PIL petitioners – minor daughter and sister of a murdered nurse in Rudrapur – through senior advocate Nitya Ramakrishnan told a bench of Chief Justice D Y Chandrachud, and Justices J B Pardiwala and Manoj Misra that it was a classic case of inexplicable police lethargy in investigating the missing person complaint of July 31.The body of the nurse was recovered on Aug 8.
Ramakrishnan said it was high time for the apex court to lay down a standard operating procedure to be scrupulously followed with promptitude by police across the country on receipt of a ‘missing girl/woman’ complaint. The bench issued notices to the Union and Uttarakhand govt and sought their response to the writ petition, which also sought an independent inquiry into the murder of the nurse at Rudrapur by a central agency under the supervision of a retired SC judge.
The minor daughter and sister of the deceased healthcare professional also hinted at the R G Kar Medical College and Hospital rape-cum-murder incident and requested the court issue a pan-India guideline for protection of hospital staff regardless of their post.
The petitioners also sought creation of a “centralised alert system to be activated when a woman is reported to be missing and cannot be located within a reasonable timeframe”.They also requested SC to direct the state govt to pay compensation to them under Uttarakhand Compensation Scheme for Women Victims/ Survivors of Sexual Assault/ Other Crimes, 2022.
