Kolkata rape murder: CBI chargesheet reveals disturbing details; Sanjay Roy’s DNA and blood stains link him to victim

KOLKATA: The RG Kar rape-murder trial will begin Nov 4. It will be heard in camera four days a week by additional district judge Anirban Das.
A Sealdah court on Tuesday also handed over a copy of the charge sheet filed by CBI to Sanjay Roy, the only accused named in it, which lays bare his role in the Aug 9 crime.

Roy was arrested on Aug 10 and his medico-legal examination was done at noon that day

Roy told the magistrate that he wanted to speak of his innocence.He pleaded with the judge to be allowed to make a submission. When the judge allowed him to speak, he said: “I will be termed guilty if I am not allowed to speak. I don’t know anything about the incident, and I have not done anything.” The court told him this was not the appropriate time. “Speak to your lawyer. You will be heard during the trial,” Arijit Mondal, the additional chief judicial magistrate, told him.
The CBI charge sheet, which was accessed partly by TOI, refers to the victim — a 31-year-old junior doctor at RG Kar hospital — as “V”. It said she died due to asphyxia as a combined effect of manual strangulation and smothering. The report, which cited Roy’s medico-legal examination report done by a professor at SSKM Hospital on Aug 10, said there was nothing to suggest that Roy was impotent. The postmortem was conducted on the victim between 6.10pm and 7.10pm on Aug 9. The interim report from the multi-institutional medical board set up by CBI mentions that rigor mortis on the victim implied that she had died 12-18 hours prior to the autopsy. The charge sheet also claims that Roy had committed the rape and murder and that he had left the third floor at 4.32am on Aug 9.
According to the CBI chargesheet, Roy reached the the hospital at 3.20am on Aug 9 and entered the emergency building. He reached the seminar hall at 4.03am, where he found his eventual victim sleeping. The CFSL, Kolkata report suggests that the woman’s kurti and undergarment was forcefully torn open. Stitches of the undergarment were ripped and the sides of the jurti’s waist were torn. The medical board’s report suggests that injuries inside the victim’s hymen clearly pointed at forceful, penetrative sexual assault, and that swabs collected from around her nipples corroborated the presence of Roy’s saliva, matched by DNA profiling.
Roy was arrested on Aug 10 and his medico-legal examination was done at noon that day. Forensic experts found five blunt-force injuries on Roy’s body, which could have happened between 24 hours and 48 hours prior to the examination. Investigators think that those injuries were consistent with marks caused by the victim’s struggles. Going by the report of the experts, these injuries could have happened at any time between noon of Aug 8 and noon of Aug 9, which coincides with the victim’s rape and murder timelines.
Investigators have reason to believe that the injuries on his body came from the victim’s resistance. Short hair found at the scene of crime also matched Roy’s. The DNA samples collected from the body of the victim also matched with Roy’s. Her blood stains were also seen on Roy’s jeans and shoes, which were later seized by Kolkata Police.
